Notice of Equitable Distribution
Notice of Equitable Distribution
A Notice of Equitable Distribution is a legal document that is filed by one party in a divorce case to request a fair and equitable division of the marital property. The notice typically includes a list of all of the assets and debts that are subject to division, along with a proposed plan for how those assets and debts should be distributed between the parties. The purpose of the notice is to put the other party on notice of the proposed property division, and to give them an opportunity to respond or object. In most cases, the notice of equitable distribution is filed early in the divorce process, and serves as a starting point for negotiations or litigation over the division of marital property. If the parties are unable to reach an agreement on the property division, the court will ultimately make a determination based on the principles of equitable distribution, which take into account factors such as the length of the marriage, the contributions of each party, and the needs and abilities of each party going forward.
