Certification of Non-Military Service
A Certification of Non-Military Service certifies that the party against whom an alimony order is sought is not currently serving in the military. This certification is required under the Servicemembers Civil Relief Act (SCRA) to protect military personnel from default judgments in court proceedings without their knowledge. The SCRA provides certain protections to active duty military members, including the right to request a stay of proceedings and the appointment of an attorney to represent their interests. The party seeking the alimony order must file the Certification of Non-Military Service with the court, affirming that they have conducted a diligent search and have no knowledge that the other party is currently serving in the military. If the other party is found to be in military service, the court may stay the proceedings or take other appropriate actions to protect their rights under the SCRA.
