Certification of Remarriage

Certification of Remarriage

A Certification of Remarriage is filed by a party seeking to terminate an alimony order based on the recipient spouse’s remarriage. The certification includes evidence of the remarriage, such as a marriage certificate, to support the request for termination of the alimony award. In most jurisdictions, remarriage of the recipient spouse automatically terminates the paying spouse’s obligation to pay alimony, as the new spouse assumes the responsibility of providing financial support. However, some alimony orders may include specific provisions regarding the impact of remarriage on the alimony obligation, such as a gradual reduction or a lump sum payment. The court will review the terms of the original alimony order and the evidence of remarriage to determine whether termination of alimony is appropriate. If the court finds that the recipient spouse has remarried, it will issue an order terminating the alimony obligation as of the date of the remarriage.
