Divorce from Bed and Board
Divorce from Bed and Board
A Divorce from Bed and Board is a legal process that allows a married couple to legally separate without actually ending the marriage. Also known as a “limited divorce” or “legal separation,” a divorce from bed and board is typically used when the parties want to live separately and divide their property, but do not want to formally divorce for religious, financial, or other reasons. In a divorce from bed and board, the court will issue an order that sets forth the terms of the separation, including the division of property, alimony, child custody, and child support. However, the parties remain legally married and cannot remarry until they obtain a final judgment of divorce. A divorce from bed and board can be a useful option for couples who are not ready or able to go through a full divorce, but who need to establish a legal framework for their separation. It can also be a precursor to a final divorce, allowing the parties to resolve many of the issues in advance and simplify the final divorce process.
