The brief should include a statement of the relevant facts, the legal issues and arguments, the applicable law and precedents, and the proposed findings and conclusions. Trial briefs are an important tool for parties to organize and present their case, to anticipate and respond to the arguments of the opposing party, and to persuade the judge or jury. They are subject to rules and deadlines for filing and service, and may be the subject of oral argument or rebuttal during the trial.
