A construction change directive is a written order issued by the property owner or their representative to the contractor, directing a change in the work or the contract documents without the contractor’s prior agreement or signature. Unlike a change order, which requires the mutual consent and agreement of the parties, a construction change directive is a unilateral action by the owner to modify the scope, time, or cost of the project, often in response to urgent or unforeseen circumstances. The directive typically includes a description of the change, the reason for the change, the expected impact on the project schedule and budget, and the method and timing of payment for the changed work. The contractor is obligated to proceed with the change as directed, even if they disagree with the terms or have not yet negotiated the final price or time adjustment. Construction change directives are an important tool for owners to maintain control and flexibility over the project, but they can also be a source of conflict and dispute if not used judiciously and fairly.
