Expert Testimony Affidavit
An expert testimony affidavit is a written statement by a qualified expert witness that sets forth their opinions and the basis for those opinions in a case. The affidavit is typically submitted in support of a motion, such as a motion for summary judgment or a motion to exclude evidence, or in response to a discovery request. The purpose of the affidavit is to provide the court and the opposing party with a preview of the expert’s testimony and to establish the admissibility of the expert’s opinions under the rules of evidence. The affidavit must include the expert’s qualifications, the materials they reviewed, the methods they used, and their conclusions and opinions. The expert must sign the affidavit under penalty of perjury, attesting to the truth and accuracy of the statements made. The opposing party has the right to depose the expert and to challenge the admissibility of the expert’s opinions through a motion to exclude or a Daubert hearing.
