Motion for Protective Order
Motion for Protective Order
A motion for protective order is a legal request filed by a party asking the court to issue an order to protect them from annoyance, embarrassment, oppression, or undue burden or expense in the discovery process. Discovery is the process by which parties exchange relevant information and evidence before trial. In some cases, a party may seek discovery that is overly broad, unduly burdensome, or invades the privacy or confidentiality of the other party or third parties. The motion must specify the specific discovery requests at issue and the reasons why a protective order is necessary. The court will review the motion and any response from the opposing party and may hold a hearing to consider the arguments. If the court grants the motion, it will issue a protective order that limits or prohibits the discovery, subject to any conditions or exceptions that balance the interests of the parties.
