Motion to Compel

A motion to compel is a legal request filed by a party in a case to ask the court to order the opposing party to provide discovery or to comply with a previous discovery order. Discovery is the process by which parties exchange relevant information and evidence before trial. If a party fails to respond to a discovery request or provides incomplete or evasive responses, the other party may file a motion to compel. The motion must specify the discovery sought and the reasons why it is relevant and necessary for the case. The court will review the motion and any response from the opposing party and may hold a hearing to consider the arguments. If the court grants the motion, it will order the opposing party to provide the requested discovery within a specified time period, subject to any objections or claims of privilege.
