Motion to Convert Bankruptcy Case
A Motion to Convert Bankruptcy Case is a legal document filed by the debtor or a creditor in a bankruptcy case to request a change in the type of bankruptcy case. The most common types of bankruptcy cases are Chapter 7 (liquidation), Chapter 11 (reorganization), and Chapter 13 (individual debt adjustment). In some cases, however, the debtor or a creditor may believe that a different type of case would be more appropriate based on the debtor’s financial situation and the nature of the debts. For example, a debtor who initially filed for Chapter 7 may later decide to convert to Chapter 13 in order to keep certain assets and repay debts over time. The Motion to Convert Bankruptcy Case must be approved by the bankruptcy court before the conversion can take effect.
