Chapter 13 Repayment Plan
A Chapter 13 Repayment Plan is a legal document filed by a debtor in a Chapter 13 bankruptcy case, setting forth the debtor’s proposed plan for repaying their debts over a period of three to five years. The plan must provide for the payment of all priority debts, such as taxes and domestic support obligations, in full, and must provide for the payment of at least a portion of the debtor’s unsecured debts. The plan must also provide for the payment of any secured debts, such as mortgages or car loans, either through the plan or outside the plan. The debtor must make regular payments to the Chapter 13 trustee, who will distribute the funds to creditors according to the terms of the plan. If the debtor successfully completes the plan, they will receive a discharge of their remaining dischargeable debts.
