Habitability Standards

Habitability standards are the minimum requirements that rental properties must meet to be considered safe and livable. These standards are typically set by state and local building codes and housing regulations, and cover issues such as:

  1. Structural integrity and weather protection
  2. Safe and reliable heating, electricity, and plumbing systems
  3. Hot and cold running water and adequate sewage disposal
  4. Adequate ventilation and lighting
  5. Safe and secure doors and windows
  6. Absence of lead-based paint hazards, mold, and pests

Landlords are required to maintain their rental properties in compliance with these habitability standards, and tenants have the right to request repairs or take legal action if the landlord fails to do so. Some states also have specific habitability requirements for issues such as smoke detectors, carbon monoxide detectors, and security devices.
