Lead-Based Paint Disclosure

The federal Lead-Based Paint Disclosure Rule requires landlords to disclose known information about lead-based paint and lead-based paint hazards in rental properties built before 1978. Landlords must provide tenants with a federally approved lead hazard information pamphlet, disclose any known lead-based paint or hazards in the property, and include a warning statement and disclosure form in the lease agreement. Landlords must also keep records of their disclosure activities and provide them to the tenant upon request. Failure to comply with the Lead-Based Paint Disclosure Rule can result in civil and criminal penalties for the landlord.
