Manifestation Determination Review (MDR) Document

A Manifestation Determination Review (MDR) is a meeting and written document that is required when a student with a disability faces disciplinary action that may result in a change of placement, such as a suspension or expulsion. The purpose of the MDR is to determine whether the student’s behavior was a manifestation of their disability, and whether the school district followed the student’s IEP and behavior intervention plan. The MDR team includes the student’s parents, relevant members of the IEP team, and other qualified professionals, and must consider all relevant information, including the student’s IEP, teacher observations, and any relevant information provided by the parents. If the team determines that the behavior was a manifestation of the student’s disability, the district must conduct a functional behavioral assessment and develop or revise a behavior intervention plan, and the student must be returned to their original placement unless the parents agree to a change. If the behavior was not a manifestation of the disability, the district may proceed with the disciplinary action, but must still provide the student with educational services. The MDR is an important tool for ensuring that students with disabilities are not unfairly disciplined for behavior that is related to their disability, and for promoting positive behavioral supports and interventions.
