Mediation and Dispute Resolution

Mediation and dispute resolution are alternative methods of resolving conflicts between landlords and tenants outside of the traditional court system. These processes involve a neutral third party, such as a mediator or arbitrator, who facilitates communication and negotiation between the parties to reach a mutually acceptable agreement. Mediation is typically a voluntary and confidential process in which the mediator helps the parties identify their interests and explore potential solutions, but does not make a binding decision. Dispute resolution, such as arbitration, may be mandatory under some lease agreements and involves a more formal process in which the arbitrator hears evidence and arguments from both sides and renders a binding decision. Mediation and dispute resolution can be faster, less expensive, and less adversarial than going to court, and may help preserve the landlord-tenant relationship.
