Motion to Extend Automatic Stay

A Motion to Extend Automatic Stay is a legal document filed by a debtor in a bankruptcy case to request an extension of the automatic stay beyond its initial duration. The automatic stay is a legal protection that goes into effect upon the filing of a bankruptcy petition and prohibits creditors from taking any further collection actions against the debtor or the debtor’s property. The automatic stay typically remains in effect until the case is closed or dismissed, or until the debtor receives a discharge. In some cases, however, the debtor may need additional time to complete the bankruptcy process and may file a Motion to Extend Automatic Stay to request an extension of the stay. The motion must be approved by the bankruptcy court before the extension can take effect.
