Objection to Discharge

An Objection to Discharge is a legal document filed by a creditor or the bankruptcy trustee in a bankruptcy case to challenge the debtor’s eligibility for a discharge of debts. A discharge is a legal order that releases the debtor from personal liability for certain types of debts and prohibits creditors from taking any further collection actions against the debtor. In some cases, however, a creditor or the trustee may believe that the debtor is not entitled to a discharge due to fraud, misrepresentation, or other misconduct. The Objection to Discharge must be filed within a certain timeframe after the meeting of creditors and must include specific allegations and evidence supporting the objection. If the objection is sustained by the bankruptcy court, the debtor may be denied a discharge or may have certain debts excepted from the discharge.
