Quiet Enjoyment

Quiet enjoyment is the legal right of tenants to peacefully occupy and use their rental unit without substantial interference or disturbance from the landlord, other tenants, or external sources. This right is implied in every residential lease agreement and protects tenants’ privacy, comfort, and ability to fully enjoy their living space. Landlords have a duty to address any issues that disrupt tenants’ quiet enjoyment, such as excessive noise, noxious odors, or harassment from neighbors. If a landlord fails to take reasonable steps to resolve these problems after being notified by the tenant, the tenant may have grounds for legal action or the right to terminate the lease without penalty.
