The Right to Quiet Enjoyment is a legal protection that ensures tenants can peacefully occupy and use their rental unit without substantial interference from the landlord or other tenants. This right is implied in every residential lease agreement and is based on the principle that tenants are entitled to a livable and comfortable home environment. Landlords have a duty to address any disturbances or nuisances that disrupt a tenant’s quiet enjoyment, such as excessive noise, noxious odors, or harassment from neighbors. If a landlord fails to take reasonable steps to resolve these issues, the tenant may have grounds for a legal claim or the right to terminate the lease without penalty.
