Right to Quiet Enjoyment

The right to quiet enjoyment is a legal principle that entitles tenants to the peaceful and undisturbed possession and use of their rental property. This means that the landlord cannot interfere with the tenant’s privacy, comfort, or use of the property, such as by entering the unit without proper notice or permission, creating excessive noise or disturbances, or allowing other tenants or third parties to harass or disturb the tenant. The right to quiet enjoyment is implied in every lease agreement and cannot be waived by the tenant. If the landlord violates the tenant’s right to quiet enjoyment, the tenant may have the right to terminate the lease, sue for damages, or obtain an injunction against the landlord.
