The Violence Against Women Act (VAWA) allows certain victims of domestic violence who are the spouses, children, or parents of U.S. citizens or lawful permanent residents to self-petition for immigrant status without the abuser’s knowledge or consent. To apply for VAWA relief, respondents must submit a self-petition (Form I-360) to USCIS, along with supporting evidence such as a personal statement, police reports, medical records, and affidavits from witnesses. In immigration court proceedings, a copy of the complete self-petition package and any relevant correspondence with USCIS should be submitted as evidence of the respondent’s eligibility for relief and their efforts to escape an abusive situation.
