Discovery Requests

Discovery Requests are formal demands for information or documents from the opposing party in a lawsuit. In a trademark infringement case, discovery requests may seek information about the defendant’s use of the mark, sales and profits, marketing and advertising, consumer confusion, and other relevant facts. Common types of discovery requests include interrogatories (written questions), requests for production of documents, requests for admissions, and depositions (oral testimony). Discovery can be a powerful tool to uncover evidence and build a case, but it can also be time-consuming, expensive, and burdensome. Parties must respond to discovery requests truthfully and completely, subject to objections and privileges. Failure to comply with discovery can result in sanctions or adverse inferences.
