Motion to Compel Discovery

A Motion to Compel Discovery is a legal request filed by a party in a lawsuit asking the court to order the opposing party to provide requested information or documents that have been withheld or inadequately responded to. In a trademark infringement case, a party may move to compel discovery if the other party fails to answer interrogatories, produce documents, appear for depositions, or comply with other discovery obligations. The motion must describe the specific discovery requests, the deficiencies in the responses, and the good faith efforts to resolve the dispute. If the court grants the motion, it may order the non-complying party to provide the discovery, pay sanctions or fees, or face other penalties. Motions to compel can be a way to enforce discovery rights and obtain critical evidence, but they can also escalate tensions and costs in the litigation.
