Cancellation of Removal Application (Form EOIR-42A or EOIR-42B) and Supporting Documents (if applicable)
Cancellation of Removal Application (Form EOIR-42A or EOIR-42B) and Supporting Documents (if applicable)
Cancellation of removal is a form of relief available to certain foreign nationals in removal proceedings who meet specific eligibility requirements. There are two types of cancellation of removal: one for lawful permanent residents (Form EOIR-42A) and another for non-permanent residents (Form EOIR-42B). To be eligible for cancellation of removal, individuals must demonstrate continuous physical presence in the United States for a specified period, good moral character, and that their removal would result in exceptional and extremely unusual hardship to their qualifying U.S. citizen or lawful permanent resident family members. In immigration court proceedings, individuals seeking cancellation of removal must file the appropriate application form and provide supporting documents, such as proof of continuous physical presence, evidence of good moral character, and documentation of the hardship their family members would face if they were removed.
