Form I-130, Petition for Alien Relative

Form I-130 is used by U.S. citizens or lawful permanent residents to petition for certain family members to immigrate to the United States. The form establishes the relationship between the petitioner and the beneficiary and is the first step in the family-based immigration process. In immigration court proceedings, a copy of the filed Form I-130 and any relevant correspondence with USCIS should be submitted as evidence of the respondent’s eligibility for adjustment of status or other relief based on a family relationship.
