Medical records document an individual’s health history, including diagnoses, treatments, and medications. In immigration court proceedings, these records may be relevant in establishing a foreign national’s eligibility for certain forms of relief, such as cancellation of removal or asylum. For example, if an individual is seeking cancellation of removal based on exceptional and extremely unusual hardship to a qualifying U.S. citizen or lawful permanent resident relative, medical records documenting the relative’s serious health conditions may be used to support the hardship claim. Similarly, for asylum cases, medical records documenting physical or psychological harm suffered by the individual in their home country may be used as evidence to support their claim of persecution.
