Withholding of removal is a form of protection available to foreign nationals who face a clear probability of persecution in their home country on account of their race, religion, nationality, membership in a particular social group, or political opinion. Unlike asylum, which provides a path to lawful permanent residence and citizenship, withholding of removal only prevents the individual from being returned to their home country and does not grant them any permanent status in the United States. In immigration court proceedings, individuals seeking withholding of removal must submit an application and supporting documents demonstrating their eligibility for this form of protection. The evidence required is similar to that needed for an asylum application, but the standard of proof is higher, requiring the individual to show that it is more likely than not that they would face persecution if returned to their home country.
