Deferred Action for Childhood Arrivals (DACA) is a program that allows certain individuals who were brought to the United States as children to apply for a temporary reprieve from removal and work authorization. To apply for DACA, respondents must submit an application package to USCIS, including the appropriate application form (Form I-821D), proof of identity and continuous residence, and evidence of education or military service. In immigration court proceedings, a copy of the complete DACA application package and any relevant correspondence with USCIS should be submitted as evidence of the respondent’s eligibility for the program and their ties to the United States.
