Form I-601A (Provisional Unlawful Presence Waiver)

Form I-601A is an application filed by certain immigrant visa applicants who are relatives of U.S. citizens or lawful permanent residents and who are inadmissible based on unlawful presence in the United States. The form allows these applicants to request a provisional waiver of their inadmissibility before departing the United States to attend their immigrant visa interview abroad. Form I-601A requires the applicant to demonstrate that their U.S. citizen or permanent resident spouse or parent would suffer extreme hardship if the waiver is not granted. If the provisional waiver is approved, the applicant can proceed with their immigrant visa application with greater assurance that they will be able to return to the United States.
