Form I-601A (Provisional Unlawful Presence Waiver)

Form I-601A is an application filed by certain immigrant visa applicants who are relatives of U.S. citizens or permanent residents and who are inadmissible to the United States based on prior unlawful presence. This form allows these individuals to request a provisional waiver of the unlawful presence ground of inadmissibility before departing the United States for their immigrant visa interview at a U.S. consulate abroad. The applicant must demonstrate that their U.S. citizen or permanent resident spouse or parent would suffer extreme hardship if the waiver is not granted.
