Form I-862, Notice to Appear

Form I-862 is the official document used by DHS to serve as a Notice to Appear (NTA). The form contains the essential information required to commence removal proceedings, including the individual’s personal information, the legal authority for the proceedings, the factual allegations and charges of removability, and the date, time, and place of the initial hearing. Form I-862 is typically served in person, by mail, or by a combination of both, depending on the circumstances. The foreign national must receive proper service of Form I-862 to ensure that they have adequate notice and an opportunity to prepare for their immigration court proceedings.
