In cases where a respondent’s mental health is at issue, such as in asylum claims based on past trauma or in applications for disability-related waivers, psychological or psychiatric evaluations can be important evidence. These evaluations, which are typically prepared by licensed mental health professionals, can provide a diagnosis of the respondent’s condition, an assessment of the impact of their experiences on their mental health, and an opinion on their ability to participate in the legal process or comply with the requirements for relief. Psychological or psychiatric evaluations should be submitted to the court and the government attorney in advance of the hearing to allow for proper consideration and cross-examination.
